Refund Policy

1. Applicability

This Return and Refund Policy applies to all agreements concluded through our webshop.

For consumers (B2C), the statutory right of withdrawal applies as described below.
For business buyers (B2B), no right of withdrawal applies.

2. Right of Withdrawal — Consumers

If you are acting as a consumer, you have the right to withdraw from the agreement without giving any reason within 14 days after delivery.

The withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, physically takes possession of the container.

Withdrawal must be reported clearly and in writing to:

3. Use During the Cooling-Off Period

During the withdrawal period, the container may only be inspected to the extent necessary to determine its nature, characteristics, and functioning, comparable to an inspection at a physical sales location.

Non-permitted use includes, but is not limited to:

• Putting the container into use for storage

• Placing the container on site for operational use

• Renting out or making the container available to third parties

• Loading the container

• Adjusting, processing, or modifying the container

• Anchoring or placing the container on a foundation

• Structurally integrating the container

Any use beyond inspection will result in liability for depreciation in value.

4. Liability for Depreciation in Value

If the container has been used more than necessary for inspection, you are liable for any resulting depreciation in value.

Depreciation in value may arise, among other things, from:

• User damage

• Placement damage

• Rust formation or corrosion caused by use

• Contamination or loading

• Cosmetic or structural modifications

• Damage during return transport

Depreciation in value will be determined by us based on a technical and visual inspection upon return receipt.

Any depreciation in value will be deducted from the amount to be refunded.

5. Condition of Return

The container must be returned:

• In the same condition as it was delivered

• Unloaded and completely empty

• Free from damage, except for normal inspection

Containers that have been structurally modified, permanently anchored, or are in poor condition may be refused for return.

6. Return Transport

The costs of return transport are fully at the buyer’s expense and risk.

Return transport must be carried out by a carrier approved by us in writing.

We are not liable for damage occurring during return transport if the transport was not carried out by an approved carrier.

7. Refund

Refunds will be made within 14 days after:

• Receipt of the container at our depot; and

• Full inspection of its technical and visual condition.

We reserve the right to suspend the refund until the container has been received and inspected.

The following amounts will be deducted from the refund:

• Any depreciation in value

• Return transport costs

• Additional costs resulting from non-permitted use

• Any repair costs

8. Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for:

• Business buyers (B2B transactions)

• Containers that have been custom-made or personalized
  For example, containers sprayed in a specific RAL colour, fitted with custom work, windows, doors, insulation, or other modifications

• Containers that have been inseparably connected to the ground after delivery

• Containers that have been structurally integrated

Buy-Back Guarantee — Non-Binding Arrangement

9. Ownership Upon Purchase

Upon purchase, you become the legal owner of the container. This means, among other things:

• The possibility of accounting depreciation

• No ongoing rental obligations

• Full control over use and purpose

10. Conditions of the Buy-Back Arrangement

We offer the possibility to submit a buy-back request in writing from 5 years after purchase.

Important conditions:

• Buy-back is not automatic

• Buy-back takes place only after a written request

• Buy-back is entirely non-binding

• No buy-back price is guaranteed in advance

At that time, we will assess the container based on:

• Technical condition

• Visual condition

• Normal wear and tear from regular use

• Any damage, corrosion, or modifications

• The market value applicable at that time

The buy-back price will be determined based on the above factors.

Containers that:

• Have been structurally modified

• Have been permanently anchored

• Show serious damage

• Are in poor condition

may be excluded from buy-back.

No rights may be derived from this arrangement prior to written confirmation by us.

11. Warranty & Liability

Our liability is limited to what is set out in the applicable general terms and conditions.

We are not liable for indirect damage, consequential damage, business losses, or loss of profit, except where mandatory law provides otherwise.
